Music Publishing – What It Is, Why It Matters, and How It Works

Music publishing is an essential part of the music industry, supporting creators and helping them generate revenue from their work. Although still a developing segment of the Polish music market, it plays a significant role in the circulation of musical works, especially in the digital environment. Publishing companies are often mistaken for record labels, particularly when an artist has a recording contract and the label assists in preparing repertoire.

Publishing vs. Record Label – What’s the Difference?

The fundamental difference between publishing and a record label can be best illustrated with an example of a musical work. Before a song can be recorded, someone must compose the music and write the lyrics – in other words, the creative layer of the work must come into existence. At this early stage, publishing plays a crucial role by representing the authors. An artist is not always the author. Many performers need someone to write lyrics or compose music for them. This is where publishing steps in.

Once the work is created, the artist may decide to record it. This is where the record label becomes important. If the artist has a recording contract, the label produces the track, oversees organizational and legal matters, and ensures that the final recording is free from legal and technical defects. While both entities contribute to an artist’s success, they perform entirely different functions.

What Do Publishing Companies Do?

Publishing companies primarily manage copyrights to musical and lyrical works, representing composers and lyricists. They also handle the promotion and licensing of works, including adaptations, arrangements, and synchronization for films or advertisements. Additionally, publishers support creators with legal and administrative matters. A record label, by contrast, focuses on the production, distribution, and promotion of sound recordings.

How Does Music Publishing Work?

It all starts with the author’s decision on whether they need a publisher. The market landscape has changed significantly compared with even five years ago. The rapid development of digital technologies means that simply having an agreement with a collective management organization (such as ZAiKS) is no longer enough for proper copyright management—especially for authors whose works are exploited globally on digital platforms.

Such authors require a publisher who can advise on how to manage their rights both in Poland and abroad. Due to global agreements between major publishing companies and digital platforms, effective rights management requires expertise and industry experience.

If the author decides to sign a publishing agreement, the publishing company represents their interests. Depending on the scope of cooperation and the level of support expected by the author, different types of publishing contracts may be concluded. Some involve transferring economic copyrights or shares in those rights, while others are licensing-only. This enables the publisher to manage the author’s works.

After the works are registered with collective management organizations, the publisher administers and oversees their exploitation and ensures proper royalty settlements. Publishers may also promote the works through cooperation with advertising agencies or film producers. They approve adaptations, derivative works, new lyrics set to existing melodies, and encourage agencies to use the author’s music in campaigns. In short, they take actions aimed at maximizing the exploitation of the work and generating additional income for the author.

Importantly, if someone wants to create an adaptation of a work or use it in a film or advertisement, they typically contact the publisher representing the author. These areas fall outside the scope managed by ZAiKS. The publisher grants the necessary permissions and licenses on behalf of the creator, safeguards their financial interests, collects royalties, and pays the author their share. This means the publisher represents the creator both in dealings with entities interested in obtaining licenses and in contacts with collective management organizations.
